Online Ticket Shop Terms & Conditions

The following Terms & Conditions ("T&C") apply to the use of the Online Ticket Shop of the Austrian Film Museum ("Film Museum"). Orders are only valid if all mandatory fields (fields marked by an asterisk) have been completed. Prior to the completion of a transaction, the customer will receive a summary of the order contents. Prices may be subject to change.
 
1. Prices
Ticket prices listed in the Film Museum or otherwise disclosed are applicable on the Online Ticket Shop. All ticket prices include sales tax. The Film Museum reserves the right to change prices on a case by case basis. These changes will be clearly stated on the order transaction as well as on tickets. Exceptions are made for pricing errors. The Film Museum reserves the right to offer reduced ticket prices for certain customers exclusively at the on-site box office.
 
2. Payment
Payment may be made by credit card or eps transfer. The transaction is completed when the customer has submitted payment details and confirmed by clicking on "Weiter zur Bezahlung/Continue to payment." The order is then binding and cannot be cancelled or changed without a legal right to withdraw. A purchase contract exists as soon as the booking transaction has been completed with a valid credit card and the payment transaction has been authorized by the relevant credit card institution or the payment has been completely transferred to our account.
 
3. Terms of Ticket Delivery

Tickets purchased online will be delivered by e-mail following completion of the payment transaction and must be presented printed (Print@home) or on a mobile phone to enter the theater.
 
4. Retention of Title
Tickets remain the property of the Austrian Film Museum until payment has been completed.
 
5. Data Protection

6. Refunds
Refunds are not available for lost, unused, or partially used tickets, including a customer arriving late to a screening or event.
 
7. Cancellations and Changes
If a film screening, lecture, or other event is replaced, delayed, or cancelled due to another screening, lecture, or event, tickets that have been purchased but not used may be exchanged for tickets to the replacement screening, lecture, or event, or for a voucher for a ticket of the same price.
 
8. Returns Policy
In accordance with section 18 (1) sub-paragraph 1 of the External Business Act (Fern- und Auswärtsgeschäfte-Gesetz), visiting a cinema is a recreational service and you may not cancel the contract based on section 11 of the External Business Act. All other existing legal rights to withdraw (especially the remaining right to withdraw of section 918 of the Austrian Civil Code in the event of default) are not precluded.

9. Miscellaneous
The e-mail address used for purchase orders will be legally binding for delivery and declarations of intent until such time as a written declaration of another e-mail address is received. In concluding the contract, the customer is required to provide complete and correct personal data to the Film Museum. The customers is responsible for any and all resulting costs of providing incorrect, incomplete, or unclear personal data. The customer is required to provide us promptly and in writing with corrections to the name and e-mail address, damages being payable otherwise. Failure to provide said corrections will result in the last written notice sent to the last known e-mail address being considered an effective delivery.

The customer assumes the risk that we may not receive data or that we may not receive data in the form sent by the customer. We will assume the accuracy of data received from the customer.
 
If a ticket is given away, the initial ticket holder is responsible for informing the new ticket holder that the Film Museum's T&C apply. The T&C are a component of all contracts between customers and the Film Museum. Scalping and reselling tickets by private individuals for Film Museum events is prohibited inside the Film Museum.

By entering the Film Museum, customers agree to the Visitor Guidelines. Valid tickets must be shown to Film Museum personnel upon request. Failing to obey the visitor guidelines can result in the customer being expelled from the event or screening. In such cases, tickets will not be refunded.
 
Austrian law shall apply to any interpretation or dispute regarding the T&C. Venue shall be the courts of Vienna.
 
We reserve the right to change or modify the T&C as necessary. Changes will only apply to future contracts. If any terms or conditions in the T&C prove to be ineffective or unenforceable, the effectiveness and enforceability of the remaining terms and conditions will not be effected. Online Shop Terms & Conditions

The following Terms & Conditions ("T&C") apply to the use of the Online Shop of the Austrian Film Museum ("Film Museum").
 
Orders are only valid if all mandatory fields (fields marked by an asterisk) have been completed. Prior to the completion of an order transaction, the customer will receive a summary of the order contents. Prices may be subject to change.
 
Customers will receive a confirmation e-mail upon successful submission of an order. This does not mean that an order has been processed. We only receive e-mails during normal business hours (Monday to Friday, 10 a.m. to 5 p.m., except public holidays). E-mails received by the server outside these hours will be considered as having arrived on the following business day. Partial or incomplete orders will not be accepted.

Customers will be informed if an order is not accepted.
 
1. Prices
Prices as posted on price lists in the Film Museum or otherwise are applicable on the Online Shop. All prices include sales tax. The Film Museum reserves the right to change prices on a case by case basis. These changes will be clearly stated on the order transaction. Exceptions are made for pricing errors. We will contact the customer if the correct price is higher. In such cases, the contract is only complete if the customer accepts the actual price. Customers will be reimbursed if the correct price is lower.
 
2. Terms of Delivery and Pick-Up of Purchased Merchandise and Vouchers
Shipping costs will be added to the price of the merchandise. Buyers will be clearly informed of the shipping costs on a separate information page when placing an order.
 
Shipping costs do not apply to merchandise picked up at the box office. (Please note our business hours and wait for pick-up notification).
 
Merchandise (books, DVDs, etc.) is shipped via Austrian Post. Merchandise paid for by credit card will be shipped/ready for pick-up within 3 business days after the transaction has been approved. Merchandise paid for by bank transfer will be shipped/ready for pick-up within 3 business days after the complete payment has transferred to our account. Domestic and international shipping is made by Austrian Post to the address provided during the order.
 
Customers accept all risks when Austrian Post is in possession of the merchandise. The Film Museum is not responsible for partial deliveries. Customers will be notified by e-mail if delivery of merchandise is delayed by at least 4 weeks and will have the option of withdrawing from the contract for the undelivered merchandise. If customers do not withdraw from the contract within the timeframe stipulated by the Film Museum, the contract will remain binding and will be fulfilled as soon as the merchandise is deliverable.
 
Vouchers purchased on the Film Museum's Online Shop will be delivered as a PDF via e-mail. Payment is only possible by credit card or bank transfer (eps). After a successful payment, vouchers will be sent promptly in a separate e-mail.

3. Payment
Payment may be made by credit card or wire transfer. The order is then binding and cannot be cancelled or changed without a legal right to withdraw. A purchase contract exists as soon as the booking transaction has been completed with a valid credit card and the payment transaction has been authorized by the relevant credit card institution or the payment has been completely transferred to our account.
 
4. Retention of Title
Merchandise remains the property of the Austrian Film Museum until full payment has been received by us.

5. Warranty Liability
Legal warranty provisions apply to all products/merchandise.
 
6. Data Protection

7. Returns Policy
You may cancel your contract of purchase for any reason within fourteen (14) days of delivery. The cancellation deadline is fourteen (14) days from the day you, or a third party appointed by you who is not the carrier, take possession of the last article (or, in the case of multiple article delivered separately: the last item). To exercise your right to cancel, you must inform us by providing us a clear expression of your intent to cancel this contract by mail or by e-mail ().

8. Refunds
The Austrian Film Museum will refund customers for the full cost of the product (less shipping costs) as quickly as possible and within fourteen (14) days of receiving notice. Refunds will be made using the same payment method the customer chose for the original transaction.
 
The Film Museum reserves the right to refuse a refund until it has received the returned merchandise.
 
The return is valid if the customer ships the merchandise back within the fourteen (14) day cancellation period.      
 
The customer is responsible for shipping costs of returned merchandise.
